These Terms of Use (“Terms”) govern your access to and use of the Hearth mobile and web applications (the “App”), the marketing website at hearth.press (the “Site”), and any related services (together, the “Services”), operated by Ben Honda, doing business as Hearth Press (“Hearth,” “we,” “us,” “our”), located in Ontario, Canada.
By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least 13 years old to use the Services. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and accepted these Terms on your behalf.
You may create an account by signing in with Apple or Google. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@m.hearth.press if you suspect unauthorized access.

You retain ownership of the content you save to your Hearth library, including recipes, notes, photos, and annotations (“Your Content”).
You grant Hearth a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, render, transmit, and process Your Content solely to provide and improve the Services to you, including reproducing Your Content in printed books that you order. This licence is limited to operating the Services and terminates when you delete the content or close your account, subject to backups described in our Privacy Policy.
You represent and warrant that you have the rights necessary to save and store Your Content in your library and to include it in a printed book that you order.
The Services include features that let you import recipes from third-party sources — URLs, pasted text, or photographs — at your direction. You are responsible for ensuring that you have the legal right to copy, store, and reproduce that content in your library and in any printed book you order. Hearth does not review or endorse imported content.
If and when you place an order for a printed book, your order is fulfilled by a third-party print partner. Printed books are custom-made for you and are final sale. We make no representations or warranties about delivery dates, transit times, or product availability beyond what is expressly stated at the time you place your order, and we are not responsible for delays, damage, or loss caused by the print partner, shipping carriers, customs authorities, or other parties outside our control.
Pricing, available formats, and order terms applicable at the time of purchase will be presented to you before you confirm your order and are subject to change without notice.
The Services, including the Hearth name, wordmark, design system, software, and content we author, are owned by Hearth and protected by intellectual-property laws. Except for Your Content and rights expressly granted in these Terms, no rights are transferred to you.
If you believe content in the Services infringes your copyright, email legal@m.hearth.press with: a description of the work allegedly infringed, the location of the allegedly infringing material, your contact information, and a good-faith statement that the use is unauthorized.
The Services are provided on an “as is” and “as available” basis. We do not guarantee that the Services will be uninterrupted, error-free, or available at any given time, and we may modify, suspend, or discontinue any part of the Services at any time without notice.
To the maximum extent permitted by law, the Services are provided without warranty of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant the accuracy, completeness, or reliability of any content in the Services, including imported recipes and any AI-generated illustrations.
Recipes provided through the Services are for personal cooking use and are not professional advice. Always exercise judgment regarding food safety, allergens, dietary needs, and use of kitchen equipment.
To the maximum extent permitted by law, in no event will Hearth, its operators, contractors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services, even if advised of the possibility of such damages.
Our total cumulative liability arising out of or in connection with the Services will not exceed the greater of (a) the amount you paid Hearth in the twelve (12) months preceding the event giving rise to liability, and (b) one hundred Canadian dollars (CAD $100).
You agree to defend, indemnify, and hold harmless Hearth from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of: (a) Your Content, (b) your use of the Services, or (c) your breach of these Terms.
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Services. You may stop using the Services at any time and delete your account from within the App.
These Terms and any dispute arising out of or relating to them or to the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You and Hearth agree to submit to the exclusive jurisdiction of the courts located in Toronto, Ontario for any dispute that is not subject to informal resolution.
Before filing a formal claim, you agree to first contact us at legal@m.hearth.press with a written description of the dispute and a proposed resolution. The parties will make a good-faith effort to resolve the dispute informally within thirty (30) days.
We may update these Terms from time to time. When we make material changes, we will update the “Effective” date at the top and, where appropriate, notify you in the App. Your continued use of the Services after a change takes effect constitutes acceptance of the updated Terms.
